The Governance of the Malaysian Conveyancing System
Fraudulent Land transactions is a never-ending saga within the conveyancing system in Malaysia. Juggling between the greediness of the fraudsters and the security of tenure, solicitors have to endure an uphill task.
Malaysia adopted the Torrens System introduced by Sir Robert Torrens in 1857, which was later recommended by Maxwell in 1897. This book covers the history of Malaysian Land Law and the theoretical aspect of "property", upon registration of land dealings, the title or interest in land shall be indefeasible. This book reviews the circumstances that affect the security of tenure that could cause the registration of a title or interest could be challenged and the application of the indefeasibility principle by the Malaysian court. The discussion in this book also focuses on the stakeholders involved within the chain of conveyancing systems. Accordingly, this book also discusses the impact of fraudulent activities that cause the registration to be defeasible.
Instructor Biography
Associate Professor Dr. Noraziah Abu Bakar is a senior lecturer at the Faculty of Law, Universiti Teknologi Mara, Shah Alam. She has served UiTM for almost 25 years. She read law (LLB(H) and LLM) at the University of Malaya and completed her doctoral thesis at Universiti Teknologi MARA. She started her research work on Malaysian Land Law and the topic for her Ph.D thesis is based on Malaysian Land Law and Conveyancing. She is currently the Deputy Chairperson for Lembaga Rayuan Negeri Selangor and Negeri Sembilan under the Town Country and Planning Act 1976. The Faculty of Law has also appointed her as the Director of the faculty's Legal Consultation Centre and she also serves UiTM Selangor in Puncak Alam Campus as the Coordinator of Law, where she is in charge of the legal matters for UiTM Selangor.
