"The ongoing battle of a Malaysian Conveyancing Lawyer against the intervention of fraudsters into the chain of conveyancing process is to ensure that registration can deliver security of tenure."

The Malaysian Conveyancing Law is regulated by the "National Land Code [Act 828]" as the primer statute and the Malaysian Bar Council is responsible in providing rulings and guidelines to assist its members pertaining to the conveyancing practices. Solicitors as the medium in a conveyancing process play a vital role at the preliminary process where they are responsible for drafting, preparing and perfecting the instrument of dealings. At this juncture, it is pertinent that the instruments should not only seem regular, but also authentic. The role played by a solicitor is important and thus, allowing non-compliance of the law, without any monitoring compliance would only benefit fraudsters. As a benchmark, the conveyancing law and practices in New Zealand and Australia is reviewed as a lesson learnt.


Instructor Biography

Noraziah Abu Bakar (PhD) was born on 14 December 1963 in Kuala Pilah, Negeri Sembilan. She is a senior lecturer at the Faculty of Law, Universiti Teknologi Mara, Shah Alam. She serves UiTM for almost 22 years. She read law (LLB (H) and LLM) at the University of Malaya and completed her doctoral thesis at University Technology MARA. She started her research work on Malaysian Land Law and her topic for her PhD Thesis is based on the Malaysian Land Law and Conveyancing. She is currently the Deputy Chairperson for Lembaga Rayuan Negeri Selangor and Negeri Sembilan under the Town Country and Planning Act 1976. The Faculty of Law has also appointed her as the Director for the faculty's Legal Consultation Centre and also serves UiTM Cawangan Selangor, Puncak Alam as the Coordinator of Law where she is in charge of the legal matters for UiTM Selangor.
